Jiwwwi.Life Terms of Use

The Jiwwwi.Life User Agreement consists of these Terms and Conditions and our Privacy Policy.

These General Terms and Conditions ("Terms") govern access to and use of our Services. Usage restrictions

When using our services, you are prohibited from:

1. Access, manipulate or use non-public areas of the Services, Jiwwwi.Life computer systems or technical provisioning systems of our providers.
2. Identify, scan, or test vulnerabilities in systems or networks.

Advertising and commercial content

Jiwwwi.Life can place advertising and commercial content on the platform. By using the Services, you agree that we and our partners may display such content.

Developers and APIs

When you use development features of our services, you must agree to our Developer Agreement and Developer Policy. The use of our APIs is subject to separate terms.

5. Your account

You are responsible for protecting your account. Use a strong password and limit its use to this account. We cannot be held liable for any loss or damage resulting from non-compliance with these security measures.

You can control most of the communications from the Services. However, we reserve the right to provide you with certain administrative and security-related communications that you may not be able to unsubscribe from.

Jiwwwi.Life reserves the right to delete, retain or process any data associated with your account at its own discretion, even after termination or deactivation of your account.

6. Termination of these conditions

You can terminate your legal agreement with Jiwwwi.Life at any time by deactivating your account and stopping using the Services. For instructions on how to deactivate your account, see your account settings.

Our decisions regarding the blocking, termination or restriction of accounts are final and are not subject to an appeal procedure. Without limiting the foregoing, and to the extent permitted by applicable law, THE JIWWWI.LIFE UNITS DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, WITH REGARD TO THE MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR THE NON-INFRINGEMENT OF ANY RIGHTS.

The Jiwwwi.Life Units make no warranty or representation and disclaim any responsibility or liability for: (i) the completeness, accuracy, availability, punctuality, security or reliability of the Services or any content, (ii) any damage to your computer system, loss of data or other damage resulting from your access to or use of the Services or any Content, (iii) the deletion or failure to store or transmit Content and other communications maintained by the Services, and (iv) whether the Services meet your requirements or are available, without interruption, without interruption or without errors.

Limitation of liability

TO THE EXTENT PERMITTED UNDER LAW, JIWWWI.LIFE UNITS SHALL NOT BE LIABLE FOR ANY INDIRECT, ACCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGE OR PENALTY DAMAGE OR ANY LOST PROFIT OR REVENUE, WHETHER DIRECT OR INDIRECT, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER IMMATERIAL LOSS BASED ON: (i) YOUR ACCESS TO OR USE OR INABILITY TO ACCESS OR USE THE SERVICES, (ii) ANY THIRD PARTY CONDUCT OR CONTENT ON THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY DEFAMATING, ABUSIVE OR ILLEGAL CONDUCT OF ANY OTHER USERS OR THIRD PARTIES, (iii) ANY CONTENT OBTAINED THROUGH THE SERVICES, OR (iv) UNAUTHORIZED ACCESS, UNAUTHORISED USE OR MODIFICATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT WILL THE TOTAL LIABILITY OF THE JIWWWI.LIFE UNITS EXCEED THE HIGHER AMOUNT OF ONE HUNDRED EUROS (EUR 100.00) OR THE AMOUNT, IF ANY, THAT YOU HAVE PAID TO JIWWWI.LIFE FOR THE SERVICES IN THE LAST SIX MONTHS.

THE LIMITATIONS OF THIS SECTION APPLY TO ANY THEORY OF LIABILITY, WHETHER IT IS BASED ON WARRANTY, CONTRACT, LAW, WRONGFUL ACT (INCLUDING NEGLIGENCE) OR OTHER LEGAL BASIS, AND REGARDLESS OF WHETHER THE JIWWWI.LIFE UNITS HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8. General provisions

We may revise these terms from time to time. The latest version is always available at jiwwwi.life/tos and governs our relationship with you. We will inform you 30 days in advance of any significant changes. If you continue to access or use our Services after the changes take effect, you agree to be bound by the revised Terms.

The laws of the Republic of Austria, excluding its rules of law, apply to these terms and all disputes arising between you and Jiwwwi.Life. All disputes are negotiated exclusively before the competent courts in Vienna, Austria.

If any provision of these Terms is held to be invalid or unenforceable, the remainder of the terms will remain in full force and effect. Failure by us to assert any right or provision of these Terms shall not constitute a waiver of such right or provision.

9. Dispute resolution and waiver of class actions 

9.1 Arbitration proceedings:
Any dispute arising out of or in connection with these Terms of Use or the use of Jiwwwi.Life will be resolved exclusively through binding arbitration. The arbitration procedure takes place online and is conducted by an arbitrator selected by Jiwwwi.Life. You expressly waive your right to negotiate such disputes before an ordinary court.

9.2 Waiver of class actions:
You agree that you will only act in your individual capacity and not as a plaintiff or member of a group in any class or agent action against Jiwwwi.Life. You expressly waive your right to participate in a class action against Jiwwwi.Life.
